The USPTO's own search is the source either way, and it is free. If you check one phrase a month, use it directly. Trendlytic saves the time when you check many phrases, and it puts the check where your research already is. The right-hand column is written by us, the people who build Trendlytic.

What you get
Etsy describes itself as a venue: its Intellectual Property Policy (updated June 2023) makes each seller responsible for the rights to what they list, and says Etsy will remove material named in a report that meets its rules, without ruling on who is right. In 2024 Etsy processed 85,591 of those reports and took down about 832,000 listings, and 38% of its IP takedowns were about trademarks (Etsy 2024 Transparency Report). So the check falls to you, and the moment it is worth anything is before you list, while changing a word costs nothing. Trendlytic puts the USPTO register one click from the phrase, whether you typed it yourself or found it in a search of Etsy's best sellers.
The live register, not a list
Every lookup reads the USPTO register. An answer someone already asked for is reused for up to 30 days, so a check is never staler than that.
Clothing called out
Shirts, hoodies and hats sit in class 25. A mark in that class gets a red flag; a mark for wine or software gets a different, calmer result you can read and weigh.
The mark, not a colour
Each hit shows the registered wording, the owner, the status, the goods it covers and its filing, registration and expiry dates.
Titles and tags, not only the print
Open any design from your results and a TM or (c) badge appears when its title or tags lean on a protected name, with the exact words it matched.
Shop names count too
Etsy takes reports against shop names and usernames as well as listings. Run the name through the same lookup before you open the shop or rebrand it.
Honest about its edge
The register covers trademarks. Copyright, the larger share of Etsy takedowns, has no register to search: for art, characters and lyrics the rule is to make your own.

See it working

Two Etsy staples, two different answers
Dog mom came back clear: no active mark on that wording in the US register on the day we checked. Mama bear did not: a live registration in class 25, next to MAMA BEAR marks for toys and for food. Both phrases sit on plenty of Etsy shirts, which is exactly why you cannot tell them apart by looking at what sells. Every check lands in your recent list, so a session of ideas ends with a column of greens and reds instead of a pile of browser tabs.

Every phrase from an Etsy search, one click from the register
Keyword Research reads the tags and titles of the Etsy listings that lead a niche and lists the phrases they use, 200 of them for dog mom, each with how many Etsy listings already compete for it. The last column is about rights. The (c) marker turns red when a phrase leans on a famous property or a real person from our list. The TM button stays grey until someone checks the phrase, then turns green or red with the USPTO answer, so the phrases you are about to put in a title or a tag get looked at in the same place you found them.
Built-in trademark check
Check any phrase against the live USPTO register before you design
Type a phrase and Trendlytic looks it up in the live USPTO register and shows who owns it, its status and its filing date. Included in every plan.
And the designs that were never yours to print are marked
When a result leans on a known brand, a character or a famous person, it arrives with a TM or copyright badge on the card. You see it while you are choosing, not after a takedown. A first filter, not legal advice.
How it works
- 1
Pick the phrase
From your notes, from a best-seller you are studying, or from the keyword list of an Etsy search.
- 2
Read the register
Clear, registered for clothing, registered for something else, or only inside a longer mark: each answer comes with the marks behind it.
- 3
List it, or change a word
A clear phrase goes into your design, title and tags. A hit in class 25 usually needs a new angle, decided before any design work.

A mockup generator for the design you make next
When your own design for the niche is ready, drop the file in and see it on 500+ t-shirt photos in one go. Pick the shots that fit your shop, on a person or on its own, and save them at up to 2000 px with no watermark. A mockup takes 1 credit from your plan the first time and nothing after that.

Frequently asked questions
How does the 3-day free trial work?
Every plan starts with 3 days free. Starting it charges $1 to check the card is real, and that $1 is not refunded. The plan price itself is only billed when the trial ends, and cancelling before then from Manage Plan means it is never charged.
I haven't sold anything yet. Is Trendlytic for me?
Yes. A search needs no shop and no sales history: type an idea and you see what already sells for it on Etsy, Redbubble, TeePublic and Amazon US, how crowded each one is, and a plain verdict. Start with the marketplace you plan to sell on. If you are not ready for a trial, the free tools at /tools need no account.
Does Etsy check my listing for trademarks before it goes live?
Not in a way you can rely on. Etsy runs automated checks for counterfeits and policy violations, but its IP enforcement works mainly on reports: a rights owner files one, Etsy removes the listing it names and contacts you. Etsy offers sellers no trademark search, so a listing can go live and come down weeks later.
What happens when my Etsy listing is reported for trademark infringement?
Etsy removes the listing named in a report that meets its rules, contacts you, and may pass on who filed it. It does not decide whether you infringed. Its counter notice covers US copyright reports only, and only the owner who filed a report can withdraw it, so with a trademark report your options are to change the listing or to settle it with the owner.
Can Etsy close my shop over trademark reports?
Yes. Etsy's policy says it ends the selling privileges of members who receive repeat or multiple infringement notices, at its discretion, and it can refuse a new shop from the same person. In 2024 it closed 26,754 shops for repeat infringement or counterfeiting (Etsy 2024 Transparency Report).
If the lookup says a phrase is clear, is it safe to sell on Etsy?
Clear means no live mark on that exact wording in the US register on the day you checked. It does not cover other countries, rights that were never registered, or copyright, and it is not legal advice. It is the first check, the one that catches most problems while they are still free to fix.
What is class 25 and why does it matter on Etsy?
The USPTO sorts marks into classes of goods, and class 25 covers clothing, footwear and headwear. A phrase registered in class 25 is registered for the very products you print. A mark in another class, wine or software for instance, is a different situation: read what it covers, and remember that very famous brands are protected beyond their own class.
Does it check copyright, characters or song lyrics?
No. There is no public register for copyright, and in 2024 copyright made up 59% of Etsy's IP takedowns. Trendlytic marks phrases and designs that lean on famous properties or real people from a curated list, with a (c) marker, but the reliable rule is the simple one: do not use art, characters, photos or lyrics you did not make.
Is there a free Etsy trademark checker?
The USPTO's own Trademark Search is free and is the source every checker reads. Our free trademark checker gives three lookups a day with no account. In Trendlytic the lookup is part of every plan, next to the Etsy research, from $19.99 a month.
